Article 1 (Purpose and Scope)
These Terms apply to every person who accesses the Site, the inquiry form, the materials-request form, or any other feature the Company provides on the Site ("User"). These Terms constitute a standard-form contract under Article 548-2 of the Civil Code.
Article 2 (Agreement to These Terms)
Use of the Site constitutes agreement to these Terms. Where the User submits the inquiry form or the materials-request form, the User shall confirm agreement to these Terms and the Privacy Policy at the point of submission.
Article 3 (Display of These Terms)
Pursuant to Article 548-3 of the Civil Code, the current version of these Terms is published on the Site at all times. The Company will, upon reasonable request from the User, disclose the content of these Terms without delay by a reasonable method.
Article 4 (Changes to These Terms)
Pursuant to Article 548-4 of the Civil Code, the Company may change these Terms in any of the following cases. The changed Terms shall take effect on the date set by the Company, provided that the Company posts on the Site the fact of the change, the content of the changed Terms, and the effective date in advance.
- When the change is beneficial to Users in general
- When the change is consistent with the purpose of the contract and is reasonable in light of the necessity of the change, the appropriateness of the changed content, the existence and content of this clause, and other circumstances
Article 5 (Intellectual Property)
Copyright, trademark rights, and any other intellectual property rights in the text, images, design, layout, logos, and other content of the Site belong to the Company or to the respective rightful owners. Users may not reproduce, redistribute, translate, adapt, publicly transmit, or commercially exploit the Site content beyond the scope of quotation permitted under Article 32 of the Copyright Act, without prior written consent of the Company or the rightful owner.
Article 6 (Prohibited Conduct)
Users shall not engage in any of the following conduct when using the Site.
- Acts that violate laws, regulations, court orders, or public order and morals
- Acts that infringe the intellectual property, reputation, privacy, or other rights or interests of the Company or any third party
- Unauthorized access, attempted unauthorized access, or any act that falls within the prohibitions of the Act on Prohibition of Unauthorized Computer Access (Articles 3, 4, 5, and 6)
- Acts of obtaining, storing, or providing another person's identification codes in violation of the above Act
- Sending computer viruses, malware, or any program designed to interfere with operation
- Acts that place an excessive load on the Site (including large-scale automated access and scraping)
- Acts that register or transmit false information
- Reverse engineering, disassembling, or decompiling the Site or attempting to extract its source code
- Any other act that the Company reasonably determines to be inappropriate
Article 7 (Handling of Submissions)
Information submitted to the Company through the inquiry form, the materials-request form, or other communication channels (excluding personal information, which is handled separately under the Privacy Policy) may be used by the Company for the purpose of responding to the submission, improving its services, and aggregating anonymized statistics.
Article 8 (Disclaimer)
The Company will provide information on the Site in good faith but makes no warranty that the information is accurate, complete, or fit for any particular purpose. The Site may contain links to third-party sites; the Company does not warrant the content of such linked sites. The Company shall be liable for damages directly and actually caused to a User by the Company's breach of contract or tortious act only in the event of the Company's willful misconduct or gross negligence. Where the Company is liable only for minor negligence, the Company's liability is limited to ¥10,000 or the actual amount of direct damages, whichever is lower. This Article does not purport to exclude any liability that cannot lawfully be excluded under the Consumer Contract Act or other applicable law.
Article 9 (Personal Information)
Personal information submitted through the Site is handled in accordance with the Act on the Protection of Personal Information. Details are set out in the Company's Privacy Policy, which forms an integral part of these Terms.
Article 10 (Suspension / Modification / Termination)
The Company may suspend, modify, add, or terminate all or part of the Site at any time at its discretion (for example, for maintenance, infrastructure changes, or security reasons). The Company shall not be liable for any damages arising from such suspension, modification, or termination, except where the Company is guilty of willful misconduct or gross negligence.
Article 11 (Exclusion of Antisocial Forces)
Users represent and warrant that they are not, and will not become, members of organized crime groups, extortionists, social-movement racketeers, or any similar antisocial force. The Company may immediately refuse service to any User found to violate this provision.
Article 12 (Severability)
If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions shall continue in full force and effect. The Company and the User shall endeavor in good faith to replace the invalid provision with a valid provision that comes closest to the original intent.
Article 13 (Governing Law)
These Terms shall be governed by and construed in accordance with the laws of Japan.
Article 14 (Exclusive Jurisdiction)
Any dispute arising in connection with the Site or these Terms shall be subject to the exclusive jurisdiction of the Saitama District Court or the Kawaguchi Summary Court, as the court of first instance.
